Terms of Service

These Terms explain how the Intek Websites subscription plans work, what is included, how billing and suspension operate, and the responsibilities of both the customer and Intek Multimedia.

1. The service

Intek Websites is a subscription-based website design, hosting and support service operated by Intek Multimedia. The service is designed to reduce the initial cost of getting online by combining an initial project payment with an ongoing monthly subscription.

By submitting an application, accepting these Terms and completing payment, you ask us to begin providing the selected website service. Your application, selected plan, agreed brief, invoices, payment records and any written scope confirmations together form part of your service agreement.

2. Plans, pricing and standard scope

*Delivery targets are estimates that begin only after payment is confirmed, the scope is agreed and all required content/access has been supplied.

Nexus Systems is a base plan, not an unlimited custom-development package.

Complex integrations, premium themes/plugins, paid APIs, SMS usage, payment-gateway costs, unusually high hosting/resource requirements, data migration, custom automation or expanded development may require a separate quotation. We will seek your approval before carrying out separately chargeable work.

3. Delivery timelines

Quoted delivery times are targets rather than unconditional guarantees. The clock starts only when (a) the required initial payment has cleared, (b) the project scope is sufficiently clear, and (c) you have supplied the information, logo, images, text, credentials and other material reasonably needed to build the website.

Where we provide a secure Website Content Portal, submission through that portal is treated as the main project-content handover. Submission by itself does not mean the content is complete. The delivery countdown begins when our team reviews the submission and marks the required content as approved/complete. If we request missing information or corrections, the countdown does not begin until those items are supplied and approved.

Standard automated delivery targets use ordinary Monday-to-Friday working days. The target may be adjusted where a Ghanaian public holiday, agreed closure period or another non-working day affects the build window.

Delays caused by missing content, slow approvals, change requests, third-party services, registrar/payment-provider delays, force majeure, technical incidents or factors outside our reasonable control extend the delivery date accordingly.

4. Scope, revisions and change requests

Each plan has a page/module allowance and included feature set. A “page” normally means one standard content page or equivalent section of a conventional website. A custom application screen, workflow, database module, integration or complex interactive feature may not be treated as a standard page.

We will make reasonable revisions during the initial build so the delivered work reflects the agreed brief. Requests that materially change the brief, add pages/modules, introduce new integrations, redesign completed areas or require substantial new work may be quoted separately.

We may recommend a plan upgrade where your requested scope clearly exceeds the plan selected.

5. Monthly billing, 3-day grace period and full hosting suspension

Your initial payment includes onboarding/project commencement and the first billing period. After that, the applicable monthly subscription is due at the beginning of each billing cycle.

Existing managed websites migrated into this platform: where a website was already live under an earlier monthly arrangement, the migration does not by itself create a new setup charge. The agreed monthly amount and next renewal date recorded for that existing service continue unless a different price or scope is separately agreed. Automated lifecycle enforcement for a migrated client begins after the updated terms are accepted, or where Intek has a documented basis to record that the client already agreed to equivalent billing and suspension terms.

A strict 3-day grace period applies after a monthly due date. If payment remains outstanding when those 3 grace days have passed, the linked hosting package/account may be fully suspended through Intek Host Manager. This is not a website-only restriction: the website, hosting control access and other services hosted inside that package, including corporate email where applicable, may become unavailable until payment is confirmed. Suspension does not cancel amounts already due.

The domain registration itself is not automatically cancelled merely because the hosting package is suspended for an overdue monthly website subscription. Domain expiry, renewal and transfer remain subject to the separate domain-registration lifecycle and applicable registrar rules.

After an overdue payment is successfully verified, our system will request restoration of the full linked hosting package through Intek Host Manager. Restoration is considered complete only after the hosting platform confirms the restore/enable action. Provider processing, DNS, email clients, caches or other third-party systems may require additional time before every service appears fully available again.

Repeated late payment, prolonged non-payment or abuse may lead to cancellation or termination under these Terms. We may change plan prices in the future by giving reasonable notice. A price change does not retroactively alter amounts already paid.

Billing and service notices: we may send transactional reminders, renewal links, overdue warnings, payment confirmations, receipts and service-status notices to the email address and/or mobile number associated with your website account. These messages are intended to administer the service and are separate from promotional marketing. You are responsible for keeping those contact details current.

6. Domains, hosting, email and third-party services

Where an eligible domain is included, it is subject to availability and ordinary registry/registrar pricing. The standard included extensions are .com, .org and .net unless we state otherwise. Premium, aftermarket, reserved or unusually priced domains are excluded and may be quoted separately.

Where your confirmed plan expressly includes ongoing renewal of an eligible domain, that renewal remains included while the website subscription remains active and in good standing. If the website subscription is cancelled or terminated before a future domain-renewal date, later domain renewal may require separate payment. Domain expiry and registrar rules still apply independently from the monthly hosting-suspension process.

Domain registration, DNS, hosting, email, payment processing, APIs and other parts of the service may rely on third-party providers. Their rules, outages, verification requirements, limits and changes can affect the service. We are not responsible for third-party failures beyond our reasonable control, but we will use reasonable efforts to assist.

Any payment-gateway transaction fees, SMS charges, premium licenses, paid plugins, external APIs or other third-party usage costs are not included unless expressly stated.

7. Your responsibilities and content

You are responsible for supplying accurate business information, lawful content and any permissions required for logos, images, trademarks, videos, text, databases and other material you ask us to publish or process.

You must review proofs and notify us of material errors. You must keep your contact and billing details current and safeguard any credentials provided to you.

You may not use the service for unlawful, fraudulent, abusive, infringing or harmful activity. The Acceptable Use Policy forms part of these Terms.

8. Ownership, subscription rights and website transfer

You retain ownership of original content, logos, trademarks and materials that you supply, subject to any third-party rights. You grant us the permission needed to host, reproduce, resize, adapt and display those materials for the purpose of providing your service.

Unless a separate written buyout or transfer agreement says otherwise, the subscription is a hosted service and is not a sale of our underlying templates, reusable code, frameworks, platform components, deployment tools, administrative systems or other pre-existing intellectual property. You receive the right to use the delivered website while your account is active and compliant with these Terms.

If you later want a source-code transfer, migration, custom export or permanent buyout, we may offer this under a separate quotation. Domain transfer requests are subject to registry/registrar rules, outstanding balances and applicable third-party charges.

9. Support, backups and availability

Included support covers reasonable assistance with the active service and routine issues within your plan. It does not include unlimited development, marketing work, content entry, major redesign, custom coding or third-party troubleshooting outside the agreed scope.

We aim to keep services available and secure, but no hosting or internet service can be guaranteed to be uninterrupted or error-free. Maintenance, security work and third-party incidents may cause temporary downtime.

Where backups are maintained, they are a recovery aid and are not a substitute for keeping your own copies of important business content. We do not guarantee that every historical version can be recovered.

10. Cancellation, termination and data after cancellation

You may request cancellation before the next billing cycle. Cancellation stops future service after the paid period ends unless we agree otherwise. Paid fees are handled under the Refund & Cancellation Policy.

We may suspend or terminate a service for non-payment, material breach, security risk, unlawful activity, repeated abuse, excessive resource use or where continuing the service would expose us or others to material harm. Where practical, we will give notice and an opportunity to remedy the issue.

After cancellation or termination, we may retain backups or account data for a limited period for recovery, accounting, legal or operational reasons. You should request any agreed export promptly. Data may later be permanently deleted and recovery is not guaranteed.

11. Disclaimers and limitation of liability

We provide the service with reasonable care and skill, but results such as sales, search-engine ranking, traffic, conversions, uptime of third-party services or approval by payment/domain providers are not guaranteed.

To the maximum extent permitted by applicable law, we are not liable for indirect, special or consequential losses, lost profits, lost opportunities, loss caused by customer content, third-party outages, customer credential compromise, or events beyond our reasonable control.

To the maximum extent permitted by law, our aggregate liability relating to a claim is limited to the fees you paid to us for the affected service during the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

12. Privacy, changes, disputes and governing law

Our handling of personal data is described in the Privacy Policy. Payment is processed through third-party payment services; we do not need to receive or store your full card or mobile-money credentials on this landing page.

We may update these Terms as the service changes. Material changes may be communicated on the website or through the contact details associated with your account. Continued use after an updated version takes effect constitutes acceptance to the extent permitted by law.

These Terms are governed by the laws of the Republic of Ghana. The parties should first try in good faith to resolve disputes through direct communication. If a dispute cannot be resolved, it may be submitted to a court or other competent forum in Ghana, subject to any mandatory legal rights.
